Recognition Kit terms and conditions

These terms govern the purchase and use of the Recognition Kit offered by The Olive Feeling. By purchasing or using any part of the Recognition Kit, you accept these terms in full. If you do not accept them, do not purchase or use the Recognition Kit.

1. Definitions

  • The Olive Feeling, “we”, “us”, or “our” means SEO by Yoni FZC, a company registered in Sharjah, United Arab Emirates, operator of olivefeeling.com.
  • Recognition means editorial recognition already granted by The Olive Feeling, such as being featured in the magazine or named in editorial coverage.
  • Recognition Kit means the paid product that lets a recognized party display and use existing Recognition.
  • Digital Certificate means the personalized digital certificate issued in your name or your brand’s name, including a verification QR code.
  • Brand Kit means the seal, badge, social media templates, and printable assets supplied for display use.
  • Verification QR means the QR code on the Digital Certificate that links to a verification page maintained by The Olive Feeling.
  • Holder, “you”, or “your” means the person or brand that purchases the Recognition Kit.

2. What the Recognition Kit includes

The Recognition Kit includes a personalized Digital Certificate, a seal and badge, social media templates, a printable version, and a Verification QR that confirms the Recognition is genuine.

3. What the Recognition Kit is

The Recognition Kit is a way to materialize and display Recognition that has already been granted. It turns existing editorial recognition into assets you can show on your channels and materials.

4. What the Recognition Kit is not

Purchasing the Recognition Kit does not buy Recognition, editorial coverage, a feature, a score, a ranking, a review, or any endorsement of your products. It does not create, change, or guarantee any past or future editorial decision. Recognition must already exist before a Recognition Kit can be issued. The Kit only reflects it.

5. Editorial independence

Editorial coverage at The Olive Feeling is never for sale. Buying the Recognition Kit gives you no influence over what we publish, who we feature, or how we cover any subject. Editorial decisions are made independently of any purchase.

6. Independent recognition, not an official body

The Olive Feeling is an independent editorial magazine, and the Recognition is an independent editorial recognition. We are not a government, a ministry, a public authority, an official institution, a certification body, or an industry association, and we do not act on behalf of any of them. The Recognition must not be presented as official, governmental, regulatory, or institutional accreditation of any kind.

7. Recognition is editorial, not a product certification

The Recognition is editorial recognition of a story, a person, or a brand. It is not a product test, a quality grade, a safety or health certification, a laboratory result, or a regulatory approval. It does not certify the quality, safety, origin, or compliance of any product. The seal must not be presented as any of these. The Recognition is based on the story and information that the brand or person shares with us. We rely in good faith on their honesty. We do not independently verify whether the facts in a story are true. What we recognize is that the brand has a story and a public human side that make it and its product distinctive. We do not confirm or guarantee that any statement within the story is accurate.

8. Eligibility

The Recognition Kit is available only to a person or brand that already has an article published about them in The Olive Feeling. A published article in the magazine is a requirement before any Recognition Kit can be issued. We may decline or cancel an order if this requirement is not met or if the Recognition cannot be verified.

9. Licence to use

On payment, we grant you a perpetual, non-exclusive, non-transferable licence to display the Digital Certificate and Brand Kit to communicate the Recognition you received. The licence is perpetual from the issue date and does not expire, subject to revocation under section 15.

10. Permitted use

You may display the Digital Certificate, seal, and badge on your website, social media, email signatures, marketing materials, and product packaging or labels, provided the display is accurate and refers to the specific Recognition granted.

11. Verification

The Digital Certificate carries a Verification QR that links to a verification page maintained by The Olive Feeling. The QR confirms that the Recognition is genuine. We maintain the verification page for as long as The Olive Feeling operates. We do not guarantee that the online verification will remain available if The Olive Feeling ceases to operate. We may deactivate the Verification QR if the licence is revoked under section 15.

12. Our use of your name and brand

We may use your name, brand name, and logo in our own marketing to promote the Recognition program and to show the brands and people we have recognized. This use is limited to communicating the Recognition and the program.

13. Restrictions

  • You may not alter, redraw, recolor, or distort the certificate, seal, or badge.
  • You may not use the assets to suggest endorsement, partnership, ranking, or product approval beyond the Recognition actually granted.
  • You may not use the assets to claim that you are the best, number one, top ranked, or superior, or to suggest a quality, safety, or regulatory certification that the Recognition does not grant.
  • You may not present the Recognition as an official, governmental, or institutional accreditation, or suggest any affiliation with a public authority.
  • You may not transfer, sublicense, sell, or share the assets with any other person or brand.
  • You may not use the assets for any entity other than the one named in the Recognition.
  • You may not use the assets in a false, misleading, unlawful, or reputationally damaging way.
  • You may not continue to use the assets after revocation.

14. Change of ownership

The Recognition is granted to the specific person or brand named in it and does not transfer automatically. If the recognized brand is sold or changes ownership, the Recognition does not pass to the new owner by default. The new owner may request that the Recognition be updated and reissued in their name, subject to a recognition update fee and our approval.

15. Revocation

Although the licence is perpetual, we reserve the right to revoke it and deactivate the Verification QR if you commit fraud, provide false information, use the Recognition in a misleading way, damage the reputation of The Olive Feeling, or otherwise breach these terms. On revocation, you must stop using the certificate, seal, and badge, and remove them from your channels. No refund is due on revocation.

16. Unauthorized use

Using the certificate, seal, badge, or Verification QR without a valid licence, or after revocation, is prohibited. We may take any lawful action to stop unauthorized use and to protect the integrity of the Recognition program.

17. Indemnity

You agree to cover and hold The Olive Feeling harmless from any claim, loss, or cost arising from your use of the Recognition Kit, from claims you make using the assets, or from your breach of these terms.

18. Intellectual property

The Olive Feeling owns all rights in the magazine name, the certificate design, the seal, the badge, and all related marks and assets. Nothing in these terms transfers ownership to you. You receive only the licence described above.

19. Accuracy of information

You confirm that any information you provide for the certificate, including names and spelling, is accurate. We are not responsible for errors caused by information you supplied.

20. Fees and payment

The Recognition Kit is sold for a single one-time fee, shown in US dollars (USD) at the point of purchase. There is no recurring, renewal, or maintenance fee. Access to the assets is provided after payment is confirmed. Prices may change over time and may be higher or lower than prices offered to others, including through promotions, special discounts, or earlier rates. The fee that applies to your purchase is the one shown at the time you buy. You are not entitled to a refund, credit, or price match if the price later changes or if another party paid a different amount.

21. Refunds

The Recognition Kit is a digital product delivered on issue. No refunds are offered once the Digital Certificate has been issued and delivered.

22. Term

The licence is perpetual from the issue date, subject to revocation under section 15. Recognition tied to a specific year or edition remains accurate as a historical fact.

23. No warranty

The Recognition Kit is provided as is. We give the Recognition and materialize it for those who already meet the requirements. We do not promise or guarantee any increase in sales, customers, revenue, brand recognition, audience, or any other commercial result from receiving or displaying it.

24. Limitation of liability

To the extent permitted by law, The Olive Feeling is not liable for any indirect, incidental, or consequential loss arising from the purchase or use of the Recognition Kit. Our total liability is limited to the amount you paid for the Kit.

25. Currency, taxes, and invoices

Prices are shown in US dollars (USD). The final price includes 5% United Arab Emirates VAT. If you require an invoice, you can request one at hello@olivefeeling.com.

26. Assignment

You may not assign your rights under these terms. We may assign or transfer these terms, including if the Recognition program or The Olive Feeling is sold or restructured.

27. Changes to the program and assets

We may update the design of the certificate, seal, and badge, and the verification system, over time. Reasonable changes of this kind do not affect the validity of your Recognition.

28. Changes to these terms

We may update these terms from time to time. The version published on olivefeeling.com at the time of your purchase applies to that purchase.

29. General

These terms are the entire agreement between you and us regarding the Recognition Kit and replace any earlier statement or promise. If any part is found invalid, the rest stays in force. Our failure to enforce a term is not a waiver of it. Nothing in these terms creates a partnership, agency, joint venture, or employment relationship between you and The Olive Feeling.

30. Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Sharjah, and any dispute is subject to the courts of Sharjah.
